Terms of Service

These Terms of Service govern your use of AI Photos of You at aiphotosofyou.com (the "service"). "We", "us", and "our" refer to Carl Ulsøe Christensen, the individual based in Denmark who operates AI Photos of You. By creating an account or using the studio, you agree to these terms. If you do not agree, do not use the service. Our Privacy Policy explains how we handle information.
1. Eligibility and your account
You must be at least 18 and legally able to enter this agreement. Provide accurate account information and protect your sign-in methods. You are responsible for activity you authorize through your account. Tell us promptly if you suspect unauthorized access. Do not sell, transfer, or share account access to bypass limits or restrictions.
2. Consent and acceptable use
Only upload photos of adults who have knowingly consented to their photos and likeness being used for AI generation and editing through this service. You must have the necessary rights to upload the photos and authorize processing by our providers. Permission from a person depicted does not replace permission from a photographer or other rights holder.
You must not use the service to:
- Create sexual content, exploitative imagery, or images involving minors.
- Impersonate someone deceptively, commit fraud, or fabricate evidence or identification.
- Harass, threaten, defame, or violate someone’s privacy or publicity rights.
- Infringe copyright, trademarks, or other rights, or otherwise break the law.
- Bypass safety controls, payment requirements, usage limits, or account protections.
- Access another person’s media, disrupt the service, or introduce malicious code.
We may refuse requests or restrict access to address violations, abuse, or legal requirements. Contact support to report nonconsensual content or a rights violation, identifying the affected content and your relationship to it. Do not send unnecessary sensitive photos in an initial report.
3. Your content and permission to process it
You retain your rights in the content you upload. You give us a limited, non-exclusive permission to host, copy, process, and transmit that content to our service providers as needed to operate the service and fulfill your requests. This includes generating, editing, storing, and delivering photos. This permission does not allow us to publish your private photos in advertising without separate permission. It ends when the content is deleted, except for processing and retention described in the Privacy Policy or required by law.
As between you and us, you may download and use your generated photos for personal or commercial purposes, subject to these terms and any third-party rights. To the extent we hold transferable rights in an output, we assign them to you. AI outputs may not qualify for copyright protection, may resemble other outputs, and may contain elements owned by others. We do not guarantee exclusive ownership or clearance for a particular use. Our application, branding, and example content remain ours or our licensors’.
4. AI results and availability
AI-generated photos can contain artifacts, inaccuracies, or an imperfect likeness. Review each result before using it and disclose its AI origin when required by law or the platform where you share it. Do not present generated photos as authentic identity documents or evidence of events that did not happen.
We do not guarantee a particular likeness, aesthetic, commercial outcome, or uninterrupted availability. Generation and editing depend on third-party services, and requests may be delayed, rejected, or partially completed. Output dimensions and editing results depend on the supported options and returned image; enhancement does not promise preservation of every original pixel. Nothing here limits rights you have when a paid service is defective or does not match its description.
5. Credits and payment
Credits are sold in one-time packages, not subscriptions. The checkout shows the price, currency, applicable taxes, and package conditions before payment. Polar acts as merchant of record for purchases; its Checkout Buyer Terms also apply to checkout and payment. Credits become available after payment is confirmed, which may take time after you return from checkout.
The studio shows the credit cost before you start a shoot. Credits are reserved when a request is accepted. Outputs marked failed return their reserved credits automatically; successful outputs remain available and consume their credits even if other outputs fail. Disliking a completed image does not automatically return credits. A new generation or edit may require more credits at the cost shown before submission.
Credits are for use within your account and cannot be transferred or exchanged for cash except through an applicable refund. Changes to package prices or generation costs apply to future purchases or requests, not requests already accepted.
6. Refunds and purchase problems
Contact support with your order identifier if credits are missing, you believe a charge is incorrect, or you want to request a refund. Do not send full payment-card details. Returning credits for a failed output is different from refunding money to your payment method. Purchase refunds are reviewed based on the issue, credits used, terms shown at purchase, Polar’s applicable buyer terms, and the law. These terms do not promise an unconditional satisfaction guarantee or make all purchases non-refundable.
A confirmed refund reverses the corresponding purchased credits. Account deletion does not itself request or issue a cash refund; contact support about a purchase before deleting your account if possible. Mandatory consumer remedies, cancellation rights, and any refund entitlement under applicable law remain available. Any legally required consent to immediate digital delivery or acknowledgment about cancellation rights must be obtained separately where required; agreeing to these terms alone does not waive those rights.
For EU/EEA consumers, a statutory 14-day withdrawal period generally applies from conclusion of an online service or digital-content contract, subject to the legal exceptions. To exercise an applicable right, send support a clear statement that you wish to withdraw, with your name, order identifier, and purchase date. No particular wording is required. Where a statutory withdrawal requires reimbursement, it will be processed within the legal deadline, normally 14 days after notice, using the original payment method unless you agree otherwise. Any deduction for services already supplied or loss of a withdrawal right is subject to the consent, information, and performance requirements of applicable law.
7. Ending use and service changes
You can stop using the service at any time and delete your account in Account after active shoots finish. Download photos you want to keep first. Deletion removes access to your library and remaining credits, subject to any refund rights and records retained as explained in the Privacy Policy.
We may suspend or end access for serious or repeated violations, fraud, security risks, or legal requirements. Where reasonably possible, we will explain the action and give you an opportunity to contact support; urgent protective action may happen immediately. We may change or discontinue features, giving reasonable notice of material changes where practicable and addressing paid, undelivered services as required by law.
8. Responsibility and disputes
We will provide the service with reasonable care and skill. To the extent permitted by law, the service is otherwise provided as available without additional warranties, including guarantees of fitness for a particular purpose or non-infringement. To the extent permitted by law, we are not responsible for indirect or consequential losses, lost business profits, or losses caused by uses that violate these terms.
Nothing in these terms excludes liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer protection that cannot legally be limited. Contact support first so we can try to resolve a dispute. These terms do not require arbitration, waive class actions, or remove access to courts or protections available under mandatory law where you live.
Danish law governs these terms, subject to mandatory consumer protections in your country of residence. Disputes may be brought before the competent courts under applicable law; this clause does not require consumers to bring claims exclusively in Denmark.
9. Changes to these terms
We may update these terms and will change the date above. For material changes, we will provide reasonable notice before they take effect where required and obtain agreement where required by law. Changes will not retroactively alter an accepted purchase or remove accrued rights. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
